A technical handover inspection of a new-build property is the formal verification that the premises comply with the developer contract, the architectural plans, and Polish Building Standards. During the inspection, it is crucial to check wall alignment and plumb lines, plaster and screed moisture levels, door opening dimensions, window joinery airtightness, and floor area accuracy (in line with the PN-ISO 9836 standard). Identifying defects prior to signing the inspection protocol obliges the developer to rectify them free of charge under the statutory warranty.

In the primary market, every step is governed by the Developer Act. It obliges the developer to hand over a defect-free property and offers you protection through statutory warranty rights and the terms set out in the information prospectus. For developers, a lack of due diligence carries substantial risk, as failing to comply with building standards leads to tangible consequences:

  • Refusal of building occupancy approval by building control, halting sales.
  • Administrative fines reaching up to 50,000 PLN – pursuant to Article 91 of the Construction Law.
  • Repair costs that absorb 10% to 20% of the fit-out budget for the investment.

What to look out for during a technical handover inspection of an apartment - screed and plasterwork

One of the key priorities when inspecting floors – especially in ground-floor apartments – is to thoroughly check the thickness of the floor screed. According to building physics and technical standards, a base layer laid over thermal or acoustic insulation must be at least 5cm thick. Why is this so crucial? When developers try to cut material costs and thin the screed down to just 2 – 3 cm, the thermal insulation of the entire floor drops drastically. In practice, this means only one thing: heat escapes, and you end up paying significantly higher heating bills.
Machine-applied gypsum plasters are now the industry standard on construction sites. They look smooth and apply quickly, but they have one major drawback – they act like a sponge and absorb ambient moisture. This is why developers take different approaches in bathrooms and wet areas:

  • They leave the walls bare, without plaster – prepared directly for tiling.
  • They use cement-lime plasters, which have significantly lower moisture absorption.

What if the developer applied gypsum plaster in the bathroom?

During the inspection, you must check its moisture content without fail. If residual construction moisture is trapped inside the wall, you should never apply under-tile liquid waterproofing membranes over it. Sealing water beneath an airtight coating is a direct route to mold spore growth – and dealing with mold in a finished interior is an experience you will definitely want to avoid.

What are the allowable tolerances and building standards for an apartment handover inspection?

All finishing elements in an apartment are subject to strict dimensional tolerances clearly defined by Polish Building Standards. A developer cannot excuse poor workmanship by blaming building technology constraints or “material characteristics” – if deviations exceed the specified numerical limits, it is simply a defect.

Below, I have prepared a detailed summary of standard handover parameters for plasters, screeds, joinery, and ceramic tiling.

Floor screeds and subfloors PN-53/B-10140 (and PN-EN 13051) < 2 mm under a 1 m straightedge and local gaps < 3 mm per 2 m. Deviation from the horizontal plane: < 5 mm across the entire room span. Residual moisture: < 2% for cement substrates under vapor-tight coverings.
Openings for internal door installation Installation guidelines and Technical Conditions Wall surface around the opening: deviations identical to plastering standards. Reveal deviation from vertical: max. 6 mm over the entire height of the opening (exceeding this causes spontaneous door leaf movement). Opening height from screed: 207 – 211 cm. Ceramic tile cladding (turnkey finish) PN-EN series standards (incl. Deviation of cladding edge from vertical and horizontal: max. 2 mm over a 2 m section. Joint width adapted to tile side length: up to 100 mm joint approx. 2 mm; from 100 to 200 mm joint approx. 3 mm; from 200 to 600 mm joint approx. 4 mm.

Floor area of the apartment

The projected floor area shown in the developer contract is indicative – the allowable post-construction deviation is usually up to 2%.

What happens if, following measurements, the floor area discrepancy exceeds this threshold? Standard practice in reputable developer contracts is a clause granting you the right to withdraw from the agreement at no cost.

How to correctly measure the usable floor area of an apartment during a handover inspection?

The method for calculating usable floor area is governed by the current building standard (PN-ISO 9836). For new developments, the developer has a legal obligation to apply its latest version, which directly impacts how many square meters you are actually paying for.
Here are the measurement rules worth knowing:

  • The area beneath permanent partition walls (such as masonry walls) is strictly excluded from the square footage. Only light partition walls that can be dismantled without structural work are included in the usable floor area.
  • Rules for calculating area under sloped ceilings: space with a height of 1.90 m is counted at 100%. Conversely, space below this height is classified strictly as auxiliary area and is not included in the apartment’s usable floor area.
  • Measurements are taken inside finished walls at floor level, accurate to two decimal places.

Moisture stains on plaster vs. "building drying" - what to do?

During an apartment handover inspection, you may come across damp patches or water stains on the plaster. Developers will often try to convince you that this is simply part of the building’s natural drying process, which will go away on its own once you turn on the heating.

Don’t fall for this. Every wall and ceiling in the property you are inspecting must be completely dry. If there is moisture, it’s a red flag. What could it actually mean?

  • A leak in the heating or plumbing system.
  • Faulty damp-proofing in the foundations.
  • Flaws in the roof insulation.

Such a defect must without question be included in the handover protocol. The developer is legally required to trace the source of the leak, repair it, and thoroughly dry out the affected structures – long before you even think about bringing in a renovation team.

Should the finishing crew straighten crooked walls left by the developer?

When reporting wall plaster deviations from the vertical or horizontal plane that exceed the standard 5 mm limit, developers often brush off the issue with a quick statement: “You will be applying a skim coat anyway, so your finishing crew will level it out.” This is a classic attempt to shift the costs and hassle onto your shoulders.

The sole purpose of a gypsum skim coat is to give the surface its final smoothness, not to correct structural or geometric flaws in the walls. Correcting deviations of 7 – 10 mm using skim coat alone is technically unacceptable – it leads to massive material consumption and drastically increases labor costs during the interior finishing stage.

Any excess beyond the tolerances specified in the PN-B-10110:2005 standard is an indisputable execution defect. The developer has a legal obligation to repair it at their own expense by chipping away and reapplying the plaster.

How developers use clever tricks to hide technical defects?

Technical handovers are not just about checking right angles and verticals; they are also a psychological game. Developers know exactly how to let your guard down, and they readily use the conditions inside the apartment to persuade you to ignore finishing defects. To achieve this, they most often rely on two simple tricks that effectively deceive the eye:

  • Construction dust and debris – these act as a perfect smoke screen. They are ideal for masking scratches and cracks in window glazing units.
  • Lack of natural light – this effectively makes it impossible to spot micro-cracks in the plaster or color variations on the walls.

Summary

Remember that the finishing crew is not responsible for correcting building defects left by the developer, and gypsum skim coat is not used to straighten walls. Signing the handover protocol without notes concludes the phase of free corrections from the developer and shifts the entire financial burden onto your shoulders. Meticulous verification of standards, angles, and verticals requires patience, but it simply pays off.
